It’s Florida in November.

About 50 high-achieving students are on a bus headed to DeLand High’s International Baccalaureate and engineering programs.

As the bus drives next to a dark-colored Volkswagen Jetta, some of the 14-year-old boys on the bus look out the window and see a young man, about 20 years old.

He’s driving, smiling, and pleasuring himself.

James Richmond is not smiling.

That would be James Richmond.

This happened repeatedly – he would expose himself to the students on the bus, and he would pleasure himself.

He was caught and charged with lewd and lascivious exposure.

If found guilty, he would face 30 years in prison, or, at the very least, being labeled a sex offender for life.

He was called a "sexual deviant" by the prosecution.

However, Mr. Richmond insisted he was not showing the students his penis.

At least, not his real penis.

He was fooling them by showing them a large fake penis.

That penis was part of a Halloween costume.

Mr. Richmond had photos of himself, weeks before, wearing his flasher costume at Halloween parties.

He had gotten lots of attention at those parties.

The prosecution countered that the jury shouldn’t laugh at Richmond’s joke and that he should be convicted.

They said "…there is zero evidence that the costume was in the car."

Finally, two years after his drive-by flashing incident, Mr. Richmond’s trial ended.

The jury said Mr. Richmond was not guilty of lewd and lascivious exposure.

However, Mr. Richmond was guilty of a joke with dangerous consequences.

It is unknown whether any of the participants in this story are going to attend Japan’s Kanamara Matsuri Festival, also known as the Festival of the Steel Phallus, a Shinto fertility festival held in Kawasaki Japan. Mr Richmond is engaged to be married, and worship at this shrine is said to promote harmony in married couples.
